On August 9, 2022, the Minister of Planning and Investment (“MPI”) issued Decision No. 1392/QD-BKHDT ("Decision 1392") announcing the list of periodic reporting regimes under the management of the MPI, replacing Decision No. 778/QD-BKHDT dated June 17, 2021. On the basis of current legal regulations, this Decision has systematized types of report in the field of investment. Accordingly, various types of report have been reduced, or merged, or removed from the list of periodical reporting regimes, specifically reducing from 160 reporting items in Decision No. 778/QD-BKHDT to 59 report items under Decision 1392.
Below, we only mention the types of report in the investment field that businesses and investors need to be responsible for. Specifically:
In the field of investment in Vietnam, Vietnamese offshore investment and investment promotion:
- Quarterly and annual reports on the implementation of investment projects of Investors and economic organizations implementing investment projects in Vietnam.
- Quarterly and annual reports on the operation of the investment projects of Investors.
- Six-month and annual reports on the implementation progress of projects during the investment; and on investment efficiency for the active projects of Investors (for offshore investment projects using state capital).
In the field of implementation and support for small and medium enterprises: Annual report on start-up investment activities of the Enterprises having start-up investment activities and the Companies managing startup investment fund.
In the field of state management of bidding: Annual report on the implementation of bidding activities of the State Economic Group and the 91 Corporation.
In the field of state management of the collective economy:
- Annual report on the results of cooperative classification and assessment of Cooperatives.
- Annual report on the cooperative operation of Cooperatives and Unions of Cooperatives.
In the field of investment monitoring and evaluation:
- Monthly and annual reports on the periodic monitoring and evaluation (for public investment programs and projects, and projects using state capital other than public investment) of Owners of public investment program and projects and Investors of public investment projects using foreign capital.
- Annual report on the summary of supervision and evaluation of investment programs and projects under the management of the Owners of programs, owners of public investment programs and projects and Investors of projects using foreign capital other than public investment.
- Six-month and annual reports on the periodic monitoring and evaluation (for PPP projects) of the Investors implementing the PPP projects.
- Report every 6 months and annually on the periodic monitoring and evaluation (for projects using other capital sources) of the Investor of projects using other capital sources.
- Six-month and annual reports on the periodic monitoring and evaluation (for offshore investment projects) of the Investor of the offshore investment projects.
In other fields: Quarterly and annual reports on the construction and development of industrial parks and economic zones; on the receipt, issuance, adjustment and annulment of the Investment Registration Certificate and the Approval Decision of the investment policy; activities of investment projects; on the operation of the investment projects; on the performance of obligations with the State; on the implementation of regulations on labor and environmental protection measures in industrial parks and economic zones of the Management Board of the industrial parks and economic zones.
This Decision shall take effect on August 9, 2022.
