On October 11, 2023, the Government issued Decree No. 74/2023/ND-CP ("Decree 74") amending and supplementing a number of articles of regulatory decrees related to decentralization of administrative procedures settlement in the maritime sector. Accordingly, Decree 74 has adjusted the competence to settle in some of the following activities:
1. For maritime signaling activities
- For procedures for approving maritime signals located in port waters: Under the jurisdiction of port authorities;
- For procedures for approving maritime signals located outside port waters or maritime signaling systems with established locations located in many port waters under the management of port authorities: Under the competence of Vietnam Maritime Administration.
In some of the cases below, maritime enterprises are not required to carry out procedures for approving the establishment of maritime signals.
- Maritime signals established for unscheduled service to ensure maritime safety only need to carry out procedures for announcing maritime announcements on the establishment of new maritime signals.
- Maritime signals belonging to construction investment projects have been agreed upon in writing or approved by competent state agencies in charge of navigation in maritime safety plans.
2. For investment in the construction and management of dry port exploitation
According to Decree 74, the Vietnam Maritime Administration will have the authority to handle procedures for announcing the suspension of operation, the closing of dry ports, and procedures for renaming dry ports. Earlier, this issue was regulated under the Ministry of Transport and Transport.
The decentralization of management and licensing authority to specialized units under the Ministry will reduce intermediaries in related administrative procedures, thereby creating favorable conditions for enterprises.
Decree 74 takes effect from November 27, 2023./.
