CHANGES IN ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF TRANSPORTATION TOWARDS MINIMIZING STATE MANAGEMENT CLUES

On 24/8/2022, the Government issued Decree No. 56/2022/ND-CP (“Decree 56”), replacing Decree No. 12/2017/ND-CP (“Decree 12”) stipulating the functions, duties, authorities and organizational structure of the Ministry of Transport.

Accordingly, from October 1, 2022, the organizational structure of the Ministry of Transport (“MOT”) has become more streamlined than the previous structure specified in Decree 12. Specifically, the MOT currently comprises 08 Departments, 08 Agencies, 01 Ministry Inspectorate, 01 Ministry Office and 05 public administrative units.

The notable point of Decree 56 is the merger of the Department of Public-Private Partnership into the Department of Planning and Investment and the separation of the General Department of Roads of Vietnam into the Department of Roads of Vietnam and the Department of Highways of Vietnam.

For the merger of the Department of Public-Private Partnership into the Department of Planning and Investment: Currently, investment in the transport sector mainly has two forms: public investment and public-private partnership (PPP) but these two forms only differ on some contents in the investment preparation step. Therefore, the MOT has decided to merge these Departments, contributing to reducing focal clues, improving the effectiveness and efficiency of state management of the Ministry. Accordingly, the authorities and responsibilities of the Department of Public-Private Partnership shall be fully transferred to the Department of Planning and Investment.

For the case of the General Department of Roads of Vietnam: In order to enforce Decree 56, the MOT has issued Decision No. 1218/QD-BGTVT dated September 23, 2022 on the functions, duties, authorities and organizational structure of the Vietnam Road Administration and Decision No. 1245/QD-BGTVT dated September 27, 2022 on functions, duties, authorities and organizational structure of the Vietnam Highway Administration.

1. The Department of Roads of Vietnam

This Department continues to inherit the authorities and responsibilities of the General Department of Roads of Vietnam with a number of main duties related to zoning, construction investment management, exploitation, use, maintenance and safety of road transport.

In addition, the Department of Roads of Vietnam has still been performing a number of tasks of competent agencies as assigned, decentralized and authorized by the Minister for highway projects that have been put into operation and use until other decisions are made.

2. The Department of Highways of Vietnam

The General Department of Roads of Vietnam was built in a separate direction, focusing on the tasks of agencies and units under the MOT related to the investment management and construction of highways.

All of the aforementioned documents and changes in the organizational structure, duties and authorities of the MOT shall take effect from October 1, 2022.
