CITIZENS WILL BE ABLE TO ACCESS THE DATABASE ON CONSTRUCTION PLANNING, CONSTRUCTION PROJECTS AND OTHER CONTRUCTION OPERATIONS FROM JANUARY 1, 2026

In order to enhance citizens' access to information and facilitate state management in construction, on September 6, 2024, the Government issued Decree No. 111/2024/ND-CP ("Decree 111"), which focuses on regulations regarding the development, management, exploitation, and use of the national information system and database on construction activities (hereinafter referred to as the 'Construction Database'). This is a completely new Decree and will lay the foundation for the development of an open data repository on construction activities and promote uniformity in state management of construction.

1. Information to be updated in Construction Database system:

The Construction Database will serve as a repository and collection of the following information:

  1. Database on construction planning (Regional construction planning; urban construction planning; rural construction planning; functional area construction planning; urban technical infrastructure planning for centrally governed cities);
  2. Database on construction investment projects and construction works (general information related to the project, construction works; documents from competent state agencies, results of administrative procedures in accordance with the law, relevant records and documents related to the investment project, construction works, and some or all related information);
  3. Database on construction norms, construction work cost, construction price indices, and other activities related to construction investment.

This information will be developed, managed centrally, and consistently from the central to local levels. Accordingly, investors and businesses will have easy access to information on planning, competent authoritys’ master plans; drawings, comprehensive explanations of the master plan, urban designs (if any), management regulations accompanying the approved master plan (if any); plans for the implementation of construction planning; general information on projects and construction works, along with documents and approvals related to administrative procedures for construction issued by competent state agencies, etc.

2. Project Investor must update the information into Construction Database within 15 days from the date of receiving the results of administrative procedures for construction:

  1.  According to the regulations of Decree No.111, the investor of construction investment project (except for head of household with separate houses) is responsible for updating detailed information related to the project, construction works into Construction Database within 15 days from the date of receiving the results of administrative procedures for construction.
  2. The information the investor must update includes: documents of competent state agencies, the results of administrative procedures as prescribed by construction law and other relevant laws (if any), records, documents related to the construction investment project, construction works, and some of other information accordance with the law

3. Organizations and individuals are allowed to access and use the information and data in the Construction Database, including the process of carrying out related administrative procedures:

  • Individuals and organizations have the right to access and use the open data published, and can access to other data by written accordance with regulations of law.

The forms of accessing  the database are as follow:

       + National data integration and sharing platforms;

       +The Ministry of Construction’s electronic portal;

       +By written request for information and data not classified as open data according to the Decree.

  • Individuals and organizations do not need to submit documents that have been integrated into the Construction Database:

According to Decree 111, data updated in the Construction Database is officially valid, equivalent to paper documents, and serves as the primary reference for querying and accessing information for related administrative procedures. Therefore, state management agencies are not allowed to require organizations or individuals to provide documents or information that is already available in the Construction Database.

4.Currently, the information system, and Construction Database are under development and completion. It is expected to be put into operation and available for nationwide use starting from January 1, 2016.
