The Law on Real Estate Business 2023 prohibits the subdivision and sale of land parcels within wards, districts, and cities classified as special-grade, grade I, grade II, and grade III urban centers; not being subject to auction of land use rights for investment in housing projects in accordance with the Land Law. For the remaining areas, provincial-level People’s Committees shall base themselves on local conditions to determine areas where project owners may transfer the rights to use land with technical infrastructure to individuals for self-construction of houses
Pursuant to the aforementioned, the People's Committee of Ho Chi Minh City enacted Decision No. 83/2024/QD-ĐT (“Decision No. 83”) on October 21, 2024, which sets forth detailed regulations regarding the identification of areas where real estate and housing project investors are permitted to transfer land use rights with existing infrastructure to organizations and individuals for self-construction within Ho Chi Minh City.
Under this Decision, real estate developers in Ho Chi Minh City are prohibited from selling land with technical infrastructure in real estate projects to individuals or organizations for self-construction of houses, unless the project is specifically for resettlement purposes in rural areas of the city and meets the requirements set forth in the 2023 Real Estate Business Law and the 2024 Land Law.
Starting October 21st, 2024, Ho Chi Minh City has implemented a citywide ban on the subdivision and sale of land plots, with the exception of those for resettlement purposes. This policy is designed to strengthen real estate management, prevent illegal construction, and uphold architectural regulations.
Decision No. 83 takes effect from October 21st, 2024.
