On November 16, 2023, the Business Registration Department of the Hanoi Department of Planning and Investment issued Announcement No. 898/TB-ĐKKD ("Announcement 898") regarding the declaration of email addresses when carrying out business registration procedures.
According to Announcement 898, organizations and individuals conducting business registration procedures within the city of Hanoi must take note of the following when declaring phone numbers and email addresses:
1. The declaration of email addresses and phone numbers during the registration of new business establishments must be complete and accurate.
2. In cases where businesses have already registered but the declaration is incomplete or inaccurate, it is necessary to update and declare the correct email addresses and phone numbers in the next closest registration change.
3. Email addresses and phone numbers must be consistently declared between the business registration dossier and the tax registration dossier at the Tax Department.
The complete and accurate declaration of phone numbers and email addresses not only enhances the effectiveness of business registration management but also enables businesses to receive information promptly. In addition to issuing physical documents, relevant notices regarding the business will be sent to the registered email addresses and phone numbers.
With this announcement, many businesses may wonder whether the email address is a mandatory requirement in the business registration dossier. According to the provisions of Article 23, Clause 2 of the 2020 Enterprise Law and in the guidance documents for implementing the Enterprise Law, as well as the business registration forms attached to Circular No. 01/2021/TT-BKHĐT guiding business registration, the email address or website is not a mandatory declaration. The announcement serves as a reminder for businesses to declare or update their primary contact email addresses used to communicate with functional agencies to ensure consistency and avoid discrepancies in the dossier, thereby safeguarding their rights and timely receipt of information from the business registration authorities.
