On July 19, 2023, the People's Committee of Hanoi issued Plan No. 190/KH-UBND regarding the rearrangement and handling of houses and land within the management scope of Hanoi city according to Decree No. 167/2017/NĐ-CP and Decree No. 67/2021/NĐ-CP of the Government ("Plan 190").
In order to achieve the goal of completing the rearrangement and handling of 100% of houses and land managed by state agencies, organizations, units, and state-owned enterprises in Hanoi by 2025 (hereinafter referred to as "Agencies, Organizations, Enterprises"), Plan 190 sets forth a series of requirements and deadlines for fulfilling these requirements for organizations and enterprises as follows:
1. Completing the submission of rearrangement and handling plans for houses and land before December 20, 2023
The People's Committee of Hanoi requires all Agencies, Organizations, and Enterprises to review all houses and land facilities under their management, including construction status, and implement the rearrangement and handling plans ("Rearrangement Plan").
a. In case the Rearrangement Plan has been approved: organizations must implement it correctly in terms of form, deadlines, and procedures.
b. In case no report on the status of houses and land has been submitted: a review, declaration, report, and completion of the Rearrangement Plan must be submitted to the Department of Finance before September 30, 2023.
c. In case the status of houses and land has been reported to the Department of Finance and falls under the approval authority of the City People's Committee: conduct a site inspection before November 20, 2023, and submit the plan to the City People's Committee before December 20, 2023.
d. In case the status of houses and land has been reported but falls under the approval authority of the Ministry of Finance (for houses and land in 04 cities: Ho Chi Minh City, Da Nang, Can Tho, Hai Phong): submit the plan to the Ministry of Finance according to the relevant laws and regulations.
The head of each Agency, Organization, and Enterprise is responsible to the People's Committee of Hanoi for not implementing or delaying the declaration, reporting, and implementation of the Rearrangement Plan.
2. Completing the land use rights certificate for houses and land facilities in 2023
a. Agencies, Organizations, and Enterprises must review and handle, within their authority, or report to competent agencies for handling the responsibility of collectives and individuals in case of occupied, disputed, misused, or lost legal documents proving the origin of houses and land.
b. For cases where houses and land facilities have not completed the land use rights certificate, competent agencies shall review and resolve for users based on the origin and related legal documents according to the provisions of the law. This must be completed in 2023, without waiting for the completion of the land use rights certificate after rearranging and handling houses and land.
In addition, the People's Committee of Hanoi also requires Agencies, Organizations, and Enterprises to report the results of their work quarterly and submit reports to the Department of Finance before the 20th of the last month of the corresponding quarter.
