Within the framework of Resolution No. 98/2023/QH15 dated June 24, 2023, of the National Assembly on piloting a number of specific mechanisms and policies for the development of Ho Chi Minh City, recently, on August 10, 2023, the Prime Minister issued Decision 20/2023/QD-TTg (“Decision 20”) piloting the decentralization for Ho Chi Minh City People’s Committee to the approval of partial local planning. Decision 20 has some notable contents as follows:
1. Pilot decentralization for Ho Chi Minh City People's Committee to approve partial adjustment of local planning
On the basis of planning projects approved by the Prime Minister, the Ho Chi Minh City People's Committee is allowed to pilot the decentralization of approval for partial adjustment of local planning on construction of functional areas, partial adjustment of urban general planning, and partial adjustment of specialized technical infrastructure planning (collectively referred to as "Partial adjustment of local planning") within the administrative boundaries under their management.
2. The People's Committee of Ho Chi Minh City shall only approve partial local planning adjustment after obtaining the consensus of the Ministry of Construction
Decision 20 takes effect from August 10, 2023.
For dossiers of partial adjustment of the planning being appraised and submitted for approval, the appraisal and approval shall be continued in accordance with the provisions of current legal documents on planning and construction.
For dossiers of partial adjustment of the planning that has not yet been submitted for appraisal or approval, the provisions of Decision 20 shall be followed.
