According to Announcement No. 135/TB-VPCP, at the meeting on March 8, 2024, regarding the Decree amending and supplementing some contents of Decree No. 54/2019/NĐ-CP, Deputy Prime Minister Tran Hong Ha concluded as follows on the management of karaoke and nightclub business activities. Deputy Prime Minister identified these as sensitive business activities requiring strict management.
The directions for enhancing management include:
1. Licensing of business operations must adhere to urban planning.
Accordingly, licensing of karaoke and nightclub establishments must ensure:
- Ensuring safety and security;
- Ensuring fire prevention and fighting measures;
- Ensuring environmental pollution and noise reduction measures;
- Ensuring no disruption to the lives of residents in residential areas, or to the operations of administrative agencies, educational, healthcare, religious, cultural heritage institutions.
2. Consider adding as a managed entity establishments combining dining services with singing and artistic performances similar to karaoke activities.
3. Supplement strict regulations on licensing operations and enhance the management of karaoke and nightclub businesses.
The Prime Minister requires that the Decree amending and supplementing some contents of Decree No. 54/2019/NĐ-CP must clarify the following aspects related to licensing and management of karaoke and nightclub businesses:
- Conditions for operating karaoke and nightclub services (such as minimum room size for singing, nightclub space, etc.);
- Validity period of the Business License for karaoke or nightclub services (Business License); cases of temporary cessation of operations, license revocation;
- Decentralization, delegation of authority to localities, with clear delineation of the state management responsibilities of each sector and level.
- Review process for evaluating applications, designs meeting fire safety, security conditions, linked with jurisdictional decentralization.
