On May 3, 2024, the Ministry of Finance issued Circular No. 27/2024/TT-BTC regulating the list and periodic transfer duration for officials and employees who do not hold leadership positions, directly manage, or directly handle financial matters at local authorities ("Circular 27"). Specifically:
1. Applicable subjects: Officials and employees who do not hold leadership positions, directly manage, or directly handle financial matters at agencies within the jurisdiction of local authorities. Exceptions to the transfer of positions according to Circular 27 include:
- Individuals with less than 18 months of remaining service until retirement age.
- Cases where periodic transfer of positions is not yet implemented, performed according to the provisions of Article 38 of Decree No. 59/2019/NĐ-CP dated July 1, 2019, of the Government detailing certain provisions and measures for implementing the Law on Prevention and Control of Corruption (pregnant women or people breastfeeding children under 36 months old; people undergoing treatment for serious illnesses; people attending centralized training for 12 months or more, etc.).
2. List of applicable professional fields:
Circular 27 specifies that the list of financial fields subject to periodic transfer of positions includes:
- Budget allocation;
- Accounting, Chief Accountant;
- Public procurement;
- Appraisal, inspection, and settlement of expenses as prescribed by the State Budget Law;
- Appraisal, valuation in auctions.
3. Periodic transfer duration: from 02 to 05 years (excluding the probationary period of officials and employees). This period is calculated from the time of decision on deployment, assignment of tasks by the competent authority according to the hierarchical management of officials.
Circular 27 shall come into effect from June 17, 2024.
