Facing the impact of the Covid-19 pandemic on education, especially on non-public preschool and primary education, on August 11, 2022, the Government issued Resolution 103/NQ-CP (“Resolution 103”) on subsidies for managerial officials, teachers, and employees of non-public preschools and primary education institutions facing difficulties due to the Covid-19 pandemic.

The subsidies under Resolution 103 are prescribed as follows:

Beneficiaries of the subsidies:

The beneficiaries of the subsidies include: managerial officials, teachers, and employees working at licensed non-public education institutions as per regulations, which was mandated to suspend operation at the request of competent authorities for Covid-19 control. This is a group of employees who do not conclude employment contracts (free agents) and particular subjects following by regulation at Clause 12 Section II Resolution 68.

Non-public education institutions include:

(1) Private preschools;

(2) Private primary education institutions; and

(3) SOS preschool, Hermann Gmeiner primary schools in Vietnamese SOS Village network.

Subjects not eligible for the subsidies:

  1. Subjects who have benefited from policies assisting employees on suspension of employment contracts or unpaid leaves in accordance with Clauses 4, 5, 6 Section II of Resolution No. 68/NQ-CP and Resolution No. 126/NQ-CP (hereinafter referred to as “Resolution 68”) – who are subjects who signed employment contracts, and are currently participating in compulsory social insurance at non-public education institutions that exclude the scope of Clause 12 Section II of Resolution 68;
  2. Subjects who voluntarily waive the benefits;
  3. Subjects who are eligible for multiple subsidies (only the highest benefits shall prevail).

Conditions for enjoying the subsidies

The aforementioned beneficiaries shall be eligible for the subsidies upon the satisfication of the following 04 conditions:

  1. They are working in non-public education institutions before the institutions are mandated to suspend from May 1, 2021 to December 31, 2021;
  2. They are taking unpaid leave for at least 01 month from May 1, 2021 to December 31, 2021;
  3. They have not benefited from policies supporting employees on suspension of employment contracts or unpaid leave in accordance with Clause 4, 5, 6 Section II of Resolution 68 since they have not participated in compulsory social insurance;
  4. They are confirmed to be working in non-public education institutions (including previous non-public education institutions or other non-public education institutions if the previous non-public education institutions cease to operate) at least until the end of the school year of 2021 – 2022.

Subsidy value and implementation deadline

Support value: the subsidy is implemented once at one of the following levels:

In accordance with Clause 12 Section II of Resolution 68, employees who do not conclude employment contracts and some specific beneficiaries are eligible for a lump-sum support of 1.500.000 VND/person. Therefore, in this Resolution, beneficiaries who have received support from Resolution 68 only eligible for a lump-sum support of 2.200.000 VND/person. Managerial officials, teachers and employees who have not benefited from subsidies are eligible for a lump-sum support of 3.700.000 VND/person.

Implementation deadline: by the end of December 31, 2022.

Subsidy deployment

Competent administration authorities: Provincial People’s Committees.

Budget:

  • Provinces and cities that send 60% of their revenues to central government budget shall fund implementation by themselves.
  • Central government budget shall finance implementation of other provinces and cities based on the following rules:

+ Central government budget shall finance 80% of the support under this Resolution in case of mountainous provinces and the central highlands.

+ Central government budget shall finance 60% of the support under this Resolution for provinces that have not been able to balance their budget (other than mountainous provinces and the central highlands).

+ Central government budget shall finance 40% of the support under this Resolution for remaining provinces and cities.

  • Provinces and central-affiliated cities shall utilize 50% of provision of local government budgets (provincial, district, and commune level) and 70% of local financial reserve fund. 

Resolution 103 took effect from the publishing date.
