OWNERSHIP TRANSFER SHALL BE APPLIED TO CARS HAVING WINNING LICENSE PLATES ATTACHED INSTEAD OF WINNING LICENSE PLATES

Previously, automobiles owners had to participate in random numbering to be entitled a license plate number for their. On November 15^th, 2022, the National Assembly issued Resolution No. 73/2022/QH15 on trial implementation of automobile license plate auction (“Resolution 73”). Accordingly, owners of automobiles shall be able to participate in automobile license plate auction to choose their desired license plate number in advance of registration. This resolution has the following main contents:

Publicize license plate numbers subject to auction

Pursuant to Article 2.1 of Resolution 73, automobile license plates subject to auction are the plates with a white background, black letters and numbers, except for the license plates issued to the automobiles of military enterprises doing business, automobiles of projects and/or economic organizations in joint ventures with foreign investors, automobiles of foreign organizations and enterprises, diplomatic missions, consular missions, representative offices of international organizations and foreigners working in foreign and international agencies and organizations operating in the Vietnamese territory.

Organizations and individuals are permitted to choose automobile license plates for auction from those which are unregistered or expected to be issue, and has been being published on the national web portal on auction assets, the national web portal of the Ministry of Public Security, the national web portal of the Traffic Police Department and/or the national web portal of the auction asset organization.

The reserve Price shall be VND 40 million and the bid increment shall be VND 5 million

1. The reserve price as well as deposit of a automobile license plate subject to auction shall be VND 40 million.
2. Auction method: The auction shall be performed under the ascending-price method. The bid increment shall be VND 5 million.
3. Auction form: Online auction.
4. In case there is only one person who registers for the auction/participates in the auction/bids at least equal to the reverse price, the license plate shall be transferred to that person.

Ownership transfer shall be applied to cars having winning license plates attached instead of winning license plates

1. Automobile auction winning license plates shall not subject to transfer, exchange, donation or inheritance, except for the case of transfer, exchange, donation, or inheritance of automobiles with the auction winning license plates.
2. Ownership validity of a automobile auction winning license plate shall be remain in case such automobile is lost, damaged, unusable, or is transferred, exchanged, or donated for registration to another vehicle under its own within 12 months from the date of loss, damage, being unusable or ownership transfer;
3. Within 12 months from the issuance date of the written confirmation of automobile auction winning license plate, if the winning bidder dies but has yet registered the automobile to attach the winning license plate, such license plate shall be transferred to the vehicle registration and management system, the legitimate heirs shall be entitled to receive the auction amount paid by the winning bidder after deducting auction organization expenses.
4. Procedures for automobile registration to attach the winning license plate shall be implemented within 12 months from the issuance date of the written confirmation of automobile auction winning license plate; in case of force majeure events or objective obstacles, this period could be extended, but shall not exceed 6 months.

This Resolution shall come into force from July 1^st, 2023, and shall be valid for 03 years.
