Recently, the National Assembly has adopted the Law No. 03/2022/QH15 amending and supplementing a number of articles of the Law on Public Investment, the Law on Investment in the form of public-private partnership, the Law on Investment, the Law on Housing, the Law on Bidding, the Law on Electricity Law on Enterprises, Law on Special Consumption Tax and Law on Execution of Civil Judgments (“Law No. 03”). Law No. 03 officially took effect from March 1, 2022.
The following article will summarize the adjustment of Law No. 03 to the Electricity Law 2004.
Specifically, Article 6.1 of the Law No. 03 has regulations on electricity development policy with new content as follows: “to attract all economic sectors to participate in investment in the construction of transmission power grids on the basis of ensuring national defense and security and according to the power development plan, electricity generation, electricity distribution, electricity wholesaling, electricity retailing and/or specialized electricity consultancy. Non-state economic sectors are allowed to operate the transmission power grid built by themselves”.
This content and the amendments and supplements of the Electricity Law have shown a change in the development policy of the electricity industry in order to maximize the capacity and private capital. This is also appropriate and facilitates businesses in the investment and operation of housing projects and large urban areas.
