REDUCE CONDITIONS AND SIMPLIFY ADMINISTRATIVE PROCEDURES IN GRANTING CERTIFICATES ON SECURITY AND FIRE PREVENTION

On May 12, 2020, the Government issued Resolution 68/NQ-CP on the program to reduce and simplify regulations related to business activities from 2020 to 2025. To implement this Resolution, within the scope of business activities under the management function of the Ministry of Public Security, on June 5, 2023, the Prime Minister issued Decision 641/QD-TTg approving the plan to reduce and simplify regulations related to business activities under the management function of the Ministry of Public Security. Accordingly, in 2023, the Ministry of Public Security will amend documents to minimize the composition of the dossier and simplify the implementation sequence for the following procedures:

1. To abolish regulations on permanent residence conditions of persons responsible for the security and order of pawn shops

Accordingly, the person in charge of security and order of the pawnshop business establishment does not need to have a permanent residence permit for at least 05 years in the commune, ward, or township where the business location is registered.

The abolition of this regulation stems from the fact that a case of "hiring people" in the locality is registered in the name of a business because there is a need to conduct a pawn service business but cannot meet the conditions has 5 years of permanent residence at the business location causing many difficulties and inadequacies in management. This plan aims to create favorable conditions for people and businesses and improve the efficiency in the management of state management agencies.

2. Simplify business conditions for fire prevention and fighting services

Accordingly, business establishments providing design consultancy, appraisal consultancy, and supervision consultancy on fire prevention and fighting and business establishments manufacturing and assembling fire prevention and fighting vehicles and equipment are not required to have a place of operation.

The abolition of regulations on the location of operation of fire prevention and fighting establishments comes from the reason that this service business establishment is responsible for providing information about the location of its operation, ensuring its safety conditions for the business of fire prevention and fighting services of their establishments and the police agency shall conduct post-inspection through inspection during operation management, periodical and irregular inspection as prescribed.

3. Remove many components of dossiers in the group of procedures for new issuance of Certificate of satisfaction of security and order conditions

Specifically, the Plan requires the abolition of the following profile components:

(i) A valid copy of the legal document of the company/project;

(ii) Valid copies of papers and documents proving the assurance of fire prevention and fighting safety conditions for the business area and the warehouse for storing raw materials and goods. (Except for the minutes of safety inspection on fire prevention and fighting falling under the competence of the People's Committees of communes).

(iii) The curriculum vitae enclosed with the judicial record card of the person in charge of security and order for the business establishment.

4. Remove many components of documents in the group of procedures for fire prevention and fighting

(i) Do not require Power of Attorney or Letter of Introduction of the person sent by the agency to contact to apply. Instead, add authorization information or introduce the applicant in the application form according to the form and the applicant presents the ID card, CCCD, and passport by electronic identification as a basis for comparison.

(ii) Remove elements of documents that can be looked up on the online public service data system such as:

  • Certificate of eligibility for fire prevention and fighting service business from the design consultancy unit on fire prevention and fighting;
  • A certified true copy (or a copy enclosed with the original for comparison) of the enterprise registration certificate of the organization or individual applying for the License;
  • Diploma or certificate of training in fire prevention and fighting knowledge of the head or legal representative;
  • Practicing certificate of fire prevention and fighting consultancy, recruitment decision, or individual labor contract.

(iii) Remove the component of documents proving the ownership/use of the operating location. Accordingly, based on the declaration and registration information, the licensing authority will switch from pre-inspection to post-inspection for this information.

(iv) For the administrative procedure group Re-issuance of the certificate of eligibility for fire prevention and fighting service business, remove the component of the loss notice certified by the police agency where the Certificate of eligibility for fire prevention and fighting business is lost.

Decision 641 takes effect from the date of issuance.
