On May 12, 2023, the Government issued Decree 22/2023/ND-CP amending and supplementing a number of articles of Decrees related to business activities in the field of natural resources and environment. This Decree governs various provisions related to conditions, dossiers and procedures related to the field of natural resources and environment. Typical are as follows:
1. Providing more flexibility for requirements on work experience of technical managers of schemes and reports in the application for water resources license
According to the previous provisions in Article 7.7 of Decree 136/2018/ND-CP, in order to apply for a water resources license, the technical manager of the scheme or report must have been directly participated in the preparation of at least 03 (three) schemes and reports. On the other hand, Decree 22 adjusts this provision towards more flexible as the technical manager shall be considered eligible whether he has at least 03 years of experience in the field of water resources and environment or has directly participated in the preparation of at least 03 schemes and reports.
2. Changing the competent agencies receiving application for mineral operation licenses, application for mineral reserves approval; and application for mineral mine closure

3. Amending and supplementing regulations on the application and procedures related to business activities in the natural resources and environment sector
- Amending and supplementing new regulations related to the composition of dossiers and the procedures for obtaining licenses related to mineral activities; hydrometeorological activities; etc.;
- Adding the application form through the online public service portal.
Decree 22 takes effect from May 12, 2023. In particular, business investment conditions and application that have been fully and validly received before the effective date of this Decree shall be settled according to the provisions at the receipt time.
