REMOVING THE POLICY OF REDUCED LICENSING ASSESSMENT FEES IN THE HEALTHCARE SECTOR FROM OCTOBER 16, 2023

In recent years, the impact of the Covid-19 pandemic and the world economic crisis has seriously affected the socio-economic development in the country and people's lives. To be able to share some of the above difficulties, on June 29, 2023, the Ministry of Finance issued Circular 44/2023/TT-BTC on reducing the collection of some fees,  fees in many areas, including the medical sector, have been updated in detail by the ATA here. Accordingly, the fee in the health sector will be reduced to 70% compared to the current fee in Circular 278/2016/TT-BTC dated November 14, 2016 and Circular No. 11/2020/TT-BTC dated February 20, 2020 amending Circular 278/2016/TT-BTC (hereinafter referred to as "Circular 278"). The above fee is applicable from July 1, 2023 through December 31, 2023.

However, after 2 months of implementation, on August 30, 2023, the Ministry of Finance issued Circular No. 59/2023/TT-BTC ("Circular 59") stipulating the collection rate, regime of collection, payment, management and use of fees in the health sector replacing Circular No. 278. Accordingly, from October 16, 2023, fee payers must pay according to the fee schedule stipulated in Circular 59, no longer be able to apply the support level as stipulated in the previous Circular 44.

1. Basically, the medical assessment fees will return to the same or increase from October 16, 2023

Circular 59 has introduced a new appraisal fee schedule on the basis of inheritance stipulated in Circular 278 and has adjustments for some specific appraisal fees below:

(a) Increase some of the following types of appraisal fees:

  • The fee for appraisal of new circulation numbers of class C equipment is collected; D: Increase from VND 5 million to VND 6 million/application;
  • Rate of collection of appraisal fees; reissue; grant adjustments to medical examination and treatment practice certificates; Re-issuance of certificates for revoked persons: Increased from 360,000 VND/time to 430,000 VND/time.

(b) Waiver of some of the following assessment fees:

  • Fees for appraisal of renewal, re-issuance of marketing licenses, publication of standards for application of medical devices/in vitro diagnostic medical equipment;
  • Appraisal fee for certification of biosafety laboratory level 1,2.

2. The Ministry of Public Security shall organize the collection of fees for dossiers falling within its licensing competence

Article 28 of the Law on Medical Examination and Treatment 2023 adds the authority of the Ministry of Public Security to issue licenses in the medical field in addition to the Ministry of Health and the Ministry of National Defense. In order to agree between legal provisions, Circular 59 added  the Ministry of Public Security and units under the Ministry of Public Security as organizations with the function of collecting appraisal fees for records under its licensing authority.

Circular 59 takes effect from October 16, 2023.
