On September 4, 2026, the Government issued Resolution No. 66.25/2026/NQ-CP (“Resolution 66.25”) on resolving difficulties and obstacles related to state management functions, tasks, and powers regarding industrial parks, geology, and minerals. The objective of Resolution 66.25 is to reassign certain state management functions, tasks, and powers in the fields of industry, geology, and minerals to the Ministry of Industry and Trade to ensure unified management and address issues arising from the current assignment of duties.

1. Transfer of state management responsibility for industrial parks

According to Resolution 66.25, state management tasks regarding industrial parks, economic zones, and export processing zones currently assigned to the Ministry of Finance under the Investment Law 2025 and Decree No. 35/2022/ND-CP (as amended and supplemented) will be transferred to the Ministry of Industry and Trade. Accordingly, the Ministry of Industry and Trade will serve as the state management agency for industrial parks, export processing zones, and economic zones, assuming all tasks, powers, and functions of the Ministry of Finance under the Investment Law and Decree No. 35/2022/ND-CP.

The Minister of Industry and Trade is responsible for issuing new regulatory documents or amending and supplementing existing ones within their authority to execute the transferred tasks.

2. Transfer of state management responsibility for geology and minerals

Resolution 66.25 transfers the state management tasks regarding geology and minerals-currently assigned to the Ministry of Agriculture and Environment and the Ministry of Construction under the Law on Geology and Minerals 2024 (as amended and supplemented in 2025) and its implementing guidance documents, including Decree 193/2025/ND-CP, Decree 189/2025/ND-CP, Decree 36/2020/ND-CP, Decree 70/2026/ND-CP, Resolution 66.4/2025/NQ-CP, and Resolution 28/2026/NQ-CP - to the Ministry of Industry and Trade. (ATA has published an article regarding this resolution  [here])

Not only at the central level, but at the local level as well, the advisory entity assisting the provincial People's Committees in performing state management functions over geology and minerals will also be transferred from the Department of Agriculture and Environment and the Department of Construction to the corresponding Department of Industry and Trade.

3. No requirement for enterprises to re-do procedures due to the change in management authority

  • For geology and minerals: Organizations and individuals are not required to request the reissuance, exchange, or re-confirmation of licenses, decisions, or official documents solely because of the change in state management authority.
  • Pending administrative files: Properly received administrative application files that have not yet been resolved will be transferred as-is to the receiving authority for continued processing; organizations and individuals are not required to resubmit files, re-perform completed steps, or repay previously settled fees and charges.
  • Inheritance of completed work: Inspection and appraisal results, opinions, Council minutes, and completed file processing steps will be inherited; processing timelines will not reset from the beginning.
  • Handover-related delays: If the handover creates a period during which state agencies cannot process files due to technical requirements associated with transferring systems, files, or data, this duration will not be counted toward the processing timeline, and the receiving authority must notify the affected organizations and individuals.
  • Requests for supplementary documents: Requests for supplementary documentation must not be made solely due to a change in the name of the ministry, receiving authority, appraising authority, or competent official.

Resolution No. 66.25/2026/NQ-CP is effective from September 15, 2026, to the end of February 28, 2027. During its effective period, if provisions on state management regarding industrial parks, geology, and minerals under this Resolution differ from those in other relevant legal normative documents, Resolution 66.25 shall prevail—except in cases where laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, or resolutions/decrees of the Government are amended, supplemented, or newly enacted and take effect during this period.
