On February 13, 2023, the Government issued Decree No. 04/2023/ND-CP ("Decree 04") amending and supplementing a number of articles of Decrees related to business investment conditions and administrative procedures under the management of the Ministry of Labor, Invalids and Social Affairs ("MOLISA") in order to simplify related regulations.
Decree 04 focuses on clarifying the plan to reduce and simplify activities in the following areas:
1. For the field of vocational education: Decree 04 amends provisions in Decree No. 49/2018/ND-CP as follows:
a. Change the authority to issue, reissue and revoke the Certificate of of eligibility for vocational education and training accreditation; and to suspend vocational education and training accreditation: From the MOLISA to the head of the Directorate of Vocational Education and Training.
b. Reduce the dossier components of application for obtaining the Certificate of of eligibility for vocational education and training accreditation for domestic organizations:
- A copy of the accreditor card is not compulsory;
- A copy of the enterprise registration certificate is not required.
c. Reduce the consideration duration for reissuance of the Certificate of of eligibility for vocational education and training accreditation: from 30 working days to 15 working days from the date the state agency receives all valid documents.
d. Supplement online application method to facilitate applicants and to be in line with the national goal of building e-government.
2. For the field of occupational safety and health: Decree 04 amends several provisions of Decree 44/2016/ND-CP as follows:
a. Supplement online application method for the following procedures:
- Issuance and reissuance of accreditor certificate;
- Declaration of organizations and individuals using machines and equipment and supplies subject to strict supervision on labor safety.
b. Reduce the dossier components of applications for accreditor certificate: Individual applicants are not required to submit a copy of identity card/passport/citizen identification card because their personal information could be extracted from the National Database on Population.
In addition, Decree 04 also promulgated a number of new forms for administrative procedures in the field of vocational education and occupational safety and health. In general, these new forms require less information, the declaration contents are also clearer, facilitating individuals and organizations.
Decree 04 took effect from the issuance date.
