The Ministry of Industry and Trade has reduced and simplified numerous administrative procedures in the field of trade promotion to better align with the practical business operations of enterprises and create more favorable conditions for traders when carrying out administrative procedures. On February 29, 2024, the Prime Minister issued Decision No. 209/QD-TTg ("Decision 209") approving the plan to cut and simplify regulations related to business activities under the management of the Ministry of Industry and Trade in 2024 ("Plan").
Accordingly, in 2024, the Ministry of Industry and Trade will revise regulations and documents to minimize documentation and simplify administrative procedures ("AP") in the field of trade promotion. Specifically:
1. Eliminating the notification procedures for promotional activities/notifications of amendments, supplements to the content of promotional programs for five forms of promotion
- Organizing cultural, artistic, entertainment events, and other events for promotional purposes;
- Providing sample products, supplying trial services to customers without charge;
- Giving away goods, providing services free of charge;
- Offering promotions in the form of discounts;
- Selling goods, providing services accompanied by purchase vouchers, service usage vouchers.
2. Reducing many document requirements for AP in the field of trade promotion
Certain legal documents related to the establishment, operation of traders, and the quality of promotional goods will be removed from the documentation requirements of corresponding AP:
- Copies of documents regarding the quality of promotional goods;
- Copies of Business Registration Certificate, Investment Registration Certificate, Decisions on establishment/other legally equivalent decisions.
3. Not requiring the legal representative to sign on documents in the registration dossier
According to Decision 209, the form of some AP will change the signature section of the trader from "Legal Representative" to "Representative of the business." This modification is in line with the current practice of delegation of management and operation authority in enterprises.
In addition to trade promotion, the Plan also eliminates three administrative procedures in the chemical sector: Procedures for issuing/reissuing/adjusting the License for Chemical Production (DOC, DOC-PSF).
Decision 209 takes effect from February 29, 2024.
