On June 23, 2022, the General Department of Taxation issued Official Letter No. 2194/TCT-KK 2022 (“Official Letter 2194”) on organizing the implementation of the contents specified in Decree No. 34/2022/ND-CP extending the payment deadline of value added tax, corporate income tax, personal income tax and land rental in 2022. In which, Official Letter 2194 has some remarkable points for taxpayers when submitting the Application for payment extension of tax and land rental (hereinafter referred to as “Tax Payment Extension”).
1. Procedures and deadline for the submission of the Tax Payment Extension
- The taxpayer directly prepares and sends the Tax Payment Extension (see the preparation instruction in Appendix 1 of Official Letter 2194) to the direct management tax authority.
- Priority is given to submission via electronic method. Only in cases the electronic submission is not possible, the taxpayer will submit the Tax Payment Extension by post or directly at the tax office.
- Submission deadline: No later than 30/09/2022, even for the case of replacement due to detection of errors.
If the submission is made after 30/09/2022, the tax payment deadline shall not be extended.
Note: The Tax Payment Extension on 2022 is only sent once to the direct management tax authority for all extended periods of the taxes and land rental.
2. Settlement in case the taxpayer is not eligible for the extension
- Taxpayers are solely responsible for determination and the extension request to ensure to be the precise extension subject.
- In case the taxpayer is not eligible for the extension (even during the extension period or when the extension period is expired), the tax authority will require the taxpayer to fully pay the outstanding tax, fines, and late payment interest to the state budget.
