THE MINISTRY OF JUSTICE HAS ANNOUNCED NEW ADMINISTRATIVE PROCEDURES RELATED TO CIVIL STATUS

On November 14, 2022, the Ministry of Justice issued Decision No. 2228/QD-BTP (“Decision 2228”) on the announcement of new and adjusted administrative procedures to be carried out at civil status registration offices under the management of the Ministry of Justice.

Basically, the settlement of administrative procedures in Decision 2228 basically remains the same as previously, except for 01 new procedure and the permittion of online application method. Specifically:

Supplement the online application method for administrative procedures performed at the district and commune levels

Under the previous regulations, the person who requested to carry out administrative procedures in the field of civil status (hereinafter referred to as the “applicant”) had to submit a dossier at the authorized civil status database-managing agency (District/Commune People's Committee). However, in order to promote online public services, Decision 2228 allowed applicants to choose either direct or online submission form.

Accordingly, in case of online application, the applicant will access the National Public Service Portal or the Provincial Public Service Portal, register an account (if needed), authenticate the user as per instructions, log in to the system and precisely identify the authorized electronic civil status database-managing agency (the “ECSDMA”).

Supplement procedures for civil status information confirmation

This is a new regulation in the field of civil status compared to the previous Decisions issued by the Ministry of Justice. Agencies, organizations and individuals may have civil status information certified in cases specified in Article 8 of Circular 01/2022/TT-BTP as follows:

  1. For individuals, when a registered civil status affair has changed or the information in the civil status papers is not consistent, the applicant could request the competent authority to issue a civil status certificate.
  2. For agencies and organizations:
  • Confirmation of information about a civil status affair or a number of civil status affairs of a registered individual;
  • Confirmation of civil status information of different individuals.

Accordingly, the applicant shall directly performs or authorizes another person to directly submit the application at the One-Stop Unit/Public Administration Center of the ECSDMA (usually the Commune People’s Committee or the District People’s Committee) or send the application by post/submit online on the National Public Service Portal or the Provincial Public Service Portal. In case the dossier is complete and valid, the applicant shall be issued with a written civil status information confirmation.

Decision 2228 took effect from the date of issuance.
