THE SIGNIFICANT POLICIES ON LAND UNDER RESOLUTION 37/NQ-CP OF THE GOVERNMENT IN 2023

On March 17, 2023, the Government issued Resolution 37/NQ-CP on the Government's Action Schedule to implement Resolution No. 18-NQ/TW dated June 16, 2022 of the Fifth Conference of the XIII Party Central Committee on “Continuing to innovate, improve institutions and policies, improve effectiveness,  efficiency of land management and use, creating motivation for our country to become a high-income developed country” (“Resolution 37”).

Resolution 37 outlines a number of policies for the land sector. Accordingly, ATA Legal Services would like to summarize and present significant policies related to the development and completion of the Law on Land (amended), and other Law projects mentioned in Resolution 37 as follows:

1. Individuals who own more land and many homes will be subject to higher rates of taxation

This is one of the notable contents of Resolution 37. Accordingly, for the schedule to complete the financial policy and mechanism for land, the Government is expected to study to promulgate the policy "Stipulating higher tax rates for users of many land areas, many houses, land speculation, delayed land use, abandonment of wasteland".

2. Supplementing the multi-purpose combined land policy

Accordingly, in the coming period, the Government will develop and propose legal regulations guiding the use and management of multi-purpose combined lands:

  • Land for national defense and security combined with labor activities of production and economic construction;
  • Residential land combined with trade and services;
  • Agricultural land combined with trade and services;
  • Land for tourism has spiritual elements;
  • Land for construction of aerial works, underground works, land formed from sea reclamation activities.

3. Policy for separation of indemnity, support and resettlement projects from investment projects

Ministry of Planning and Investment will continue to implement and summarize the policy of separation of indemnity, support, and resettlement projects from investment projects for prior implementation as a basis for supplementing the draft Land Law.

Land acquisition shall be carried out only after the plan on compensation, support and resettlement is approved.

Resolution 37 takes effect from March 17, 2023.
